TERMS AND CONDITIONS OF USE

GENERAL TERMS AND CONDITIONS OF SALE

1. INFORMATION ON THE IDENTITY OF THE SELLER AND THE RELATED PRODUCTS.

1.1) These General Terms and Conditions of Sale concern the purchase of products and services, via telematic network on the website http://www.martyandpaul2010.it, which is the exclusive property of PAOLO DI FELICE, SOLE PROPRIETORSHIP with VAT number IT 13188721008
1.2) The Company carries out the following activities: a) exclusively online trading, on behalf of third parties, of Hi-fi articles for cars and electronic and mechanical spare parts for vehicles in general;
1.3) The Customer, by sending the confirmation of their purchase order for the selected product(s) electronically, declares to have read and to fully accept all the general terms and conditions of sale indicated, and undertakes to fully observe them. The Customer also acknowledges that the Company PAOLO DI FELICE will only be bound by these terms of sale and by no others, unless previously agreed in writing.

2. LEGAL WARRANTY AND RIGHT OF WITHDRAWAL IN FAVOR OF THE CONSUMER.

3. SHIPPING

3.1) The order placed by the customer is processed within 24 working hours from receipt of payment.

  • The order processing time may vary depending on the type of goods purchased; to know the actual delivery times, please refer to the individual product sheet.
  • All products are shipped by express courier, with trackable shipping and delivery within 5-7 working days, except for unforeseen events not attributable to the Company PAOLO DI FELICE: the shipment tracking will be provided to the customer directly via email and/or SMS to the contacts provided at the time of order.

4. PAYMENTS AND INVOICING

4.1) The only accepted payment methods are as follows:


a) Advance bank transfer to the IBAN details indicated in the online purchase form. In this case, the product will only be shipped after the payment has been received in the Company's bank account. Therefore, copies of bank transfers will not be considered valid proof of payment. If proof of payment is not provided within 5 (five) days from the sending of the order by the Customer, the purchase contract will be considered automatically terminated and the Company PAOLO DI FELICE will not be obliged to ship the product.

b) Paypal (Paypal account and all major credit cards)

5. RETURNS AND REFUNDS

5.1) Regarding the rules concerning "Returns and Refunds", the Customer expressly declares to accept the following conditions, set out in the goods return form: "The item must be returned inside the original box, with the original packaging. The product must not show any tampering, or even simple alteration, of its external and internal characteristics; in particular, the manufacturer's warranty seal must be intact, as well as the wiring must not be altered.
Together with the item, as described above, the main cable must be shipped, and ONLY the accessories for which a problem has been found, i.e. malfunctioning. In the event that the shipped package contains elements or accessories other than those previously indicated, the Company will not be responsible for their possible loss, alteration or destruction.
It is absolutely mandatory to include inside the package a valid proof of purchase of the product (receipt or invoice). Please note, in any case, that if a receipt issued to a consumer is presented, the two-year warranty will run from the date of purchase of the product. Otherwise, in the case of an invoice issued to a professional, the warranty will be valid for one year, starting from the date of purchase of the product, as per applicable civil law. RMA form signed by the Customer, and for which NO warranty will apply) or in case of loss of goods during transport. For all these cases, the Company will not be held responsible.
If all the previously described conditions are not met, the Company will consider the item NOT eligible for warranty assistance. The product, therefore, will be returned to the sending Customer, in the condition in which it was received, with costs exclusively at their expense. In addition, a penalty of €50.00, plus VAT as required by law, will be charged to the Customer, for the time spent by the Company's technicians in carrying out the first assistance and product verification."

5.2) The consumer has the right to exercise the right of withdrawal provided for by the Consumer Code, within 14 days from the conclusion of the contract, dissolving the contractual bond and obtaining the return of the price paid. The period for exercising the right of withdrawal starts: a) for goods, from the day they are received by the consumer; b) for services, from the day the contract is concluded. If the goods have been delivered, the consumer must return them (at their own expense) within 14 days (the postmark is proof) from the day of receipt of the goods. The refund of the price paid will be made within 14 days from the moment the seller has received the product and verified its perfect integrity, without prejudice to the seller's disclaimer of any liability for any damage that the product may suffer during shipping by the consumer (art. 63, paragraph 2, Consumer Code).

  • How to exercise the right of withdrawal:
  • to this end, the Customer must contact the Seller within 14 days after delivery of the products or within 14 days after the purchase of the services, by filling in the appropriate RMA form, containing all the necessary and useful information for the correct processing of the return and refund procedure;
  • this communication must necessarily contain all of the following: a) the Customer's express intention to withdraw in whole or in part from the purchase contract; b) the number and copy of the document (invoice – transport document) proving the purchase of the order for which the right of withdrawal is to be exercised; c) the description and codes of the Products for which the right of withdrawal is exercised.

6. EXCLUSIVE JURISDICTION

6.1) Pursuant to art. 66 bis Legislative Decree 206/2005, for civil disputes relating to the execution or interpretation of this contract, the mandatory territorial jurisdiction is that of the Judge of the place of residence or domicile of the Consumer, if located within the territory of the State.
In the event of purchase by a NON-Consumer, exclusive territorial jurisdiction belongs to the Court of Rome.

7. APPLICABLE RESIDUAL REGULATORY FRAMEWORK

7.1) For anything not expressly provided for in these general terms and conditions of sale, reference is made to the regulatory framework relating to obligations and contracts as set out in the current Italian Civil Code.
